Counter affidavit filed today be taken on record.
Heard learned counsel for the applicant, learned A.G.A. for
the State and perused the record.
Learned counsel for the applicant contended that the
applicant is a licence holder of the soap factory with the
name of Babban Soap Factory and for manufacturing the
soap animal fat etc. is also required which has been noted in
the form No. 10 under Central Sales Tax Rule, 1957.
Allegation is that the applicant was preparing deshi ghee,
though, there is no recovery of deshi ghee from his
possession. Prayer for bail of co-accused, Ram Lal and
Dharm Pal and Sabir have already been allowed by this court.
However the applicant is in jail since 28.1.2010.
In view of the facts and circumstances, without observation
on merit it is a fit case for bail. Let the applicant namely,
Babban Khan be released on bail in Case Crime No. 668/207
of 2009, under Sections 270, 272, 278, 420 IPC, P.S. Kotwali
Dehat (O.P. Nai Mdandi), District Buland Shahar on his
furnishing a personal bond with two sureties each in the like
amount to the satisfaction of the Court concerned.
