Supplementary affidavit has been filed today. It may be taken on record.
Heard learned counsel for the applicant, learned AGA appearing for the State
and perused the record.
It is contended by learned counsel for the applicant that co-accused Raju
Srivas has been allowed bail by this court and case of the applicant stands on
same footing.
Learned AGA contended that applicant was also involved in committing
murder of deceased along with co-accused Raju Srivas.
This case is based on circumstantial evidence. Co-accused Raju Srivas has
been granted bail by this court and the case of the applicant stands on same
footing.
Considering the facts and circumstances of the case and submissions made by
the learned counsel for the applicant and without expressing any opinion on
the merits of the case, the applicant is also entitled to be released on bail on
the ground of parity.
Let the applicant Babloo @ Rafiq involed in Case Crime No. 491/2008, u/s
394, 302 IPC in Special Case no. 116 of 2008, P.S. Mauranipur, District
Jhansi be released on bail on his furnishing a personal bond with two sureties
each in the like amount to the satisfaction of the court concerned.
