Call for the L.C.R of G.R. No 318 of 2002 arising out of Koderma(Telaiya)
P.S.Case No. 194 of 2002(T.R.No. 136 of 2009) from the court of Sri. Dinesh Kumar,
Judicial Magistrate,Ist Class,Koderma along with the judgment recorded in Cr.Appeal
No. 32 of 2009 by the Additional Sessions Judge, FTC Koderma.
Put up this case after three weeks.
Mr. Deepak Kumar, the learned counsel appearing for the petitioner submitted
that the petitioner was the husband of the informant who was convicted under section
498A and allied sections of the Indian Penal Code. He was sentenced to undergo
rigorous imprisonment for the maximum period of two years and to pay fine of
Rs.1000/- with default stipulation. Against which he preferred appeal which was also
dismissed and then he surrendered in the court below on 28.1.2011.
The learned counsel submitted that the petitioner was all along on bail during
trial and in appeal and had never misused the privilege of bail, hence his prayer for ad-
interim bail may be considered .
Taking the considered view, during pendency of this Cr.Rev, sentence imposed
upon the petitioner Bablu Singh shall remain suspended, on executing bail bond of Rs.
10,000/-(Rupees ten thousand) with two sureties of the like amount each to the
satisfaction of the Trial Magistrate,Koderma with the condition that the bailors would
be his near relatives and he would cooperate in disposal of this Cr.Rev failing to which
appropriate order shall be passed vacating the ad-interim bail order.
