The petitioner is aggrieved by the order dated 6.6.2009,

by which the learned Assistant Sessions Judge, Patna City, in

Sessions Trial No.820 of 1999, has refused the prayer of the

petitioner for getting the DNA test of the child in question.

Considering that the order impugned is completely valid

and section 114 of the Evidence Act can be pressed into service by

the prosecution, I am not inclined to interfere in the matter.

The application is dismissed.
