The petitioner has sought a direction to the respondents

to allotment him a plot under the oustees category as per his

entitlement. It is claimed that agricultural land belonging to the

petitioner, Shri Harjit Singh and Nasib Kaur (to the extent of 1/3rd

share each) comprised in Khasra No. 41, Khatoni No. 42, Rectangle

No. 8, Khasra No. 8 (7-16), 13 (7-11), total 15 Kanals 7 Marlas,

falling within the revenue estate of village Judian, Tehsil Kalka,

District Ambala, as per jamabandi for the year 1981-82, was acquired

in pursuance to notification dated 27.8.1981 and declaration dated

10.1.1983 issued under Section 4 and 6 of the Land Acquisition Act,

1894. The land was acquired for the public purpose, namely, for

development and utilisation of the land as commercial and residential

areas for the Urban Estate of Panchkula. It has been asserted that

despite efforts made by the petitioner, no plot has been allotted to him

under the oustees quota. In that regard, the petitioner has also sent a

legal notice dated 15.12.2007 (P-17), however, the same has not

evoked any response.

Without going into the merits of the case, we deem it just

and appropriate to direct respondent Nos. 2 and 3 to take cognizance

of the legal notice, dated 15.12.2007 (P-17) sent by the petitioner and

decide the same expeditiously preferably within a period of two

months from the date of receipt of a certified copy of this order. It

shall be appreciated if a speaking order is passed.

Petition stands disposed of in the above terms.
