ORAL
ORDER

On
8.3.2011, this Court has passed following order:

“Learned
APP Mr. Jani has contended that he has received the letter dated
6.3.2011 from the Deputy Superintendent, Ahmedabad Central Jail,
which shows that the accused Jivanji Kalaji Thakor (appellant in
Criminal Appeal No.600 of 1991) of Sessions Case No.102 of 1989, has
been released on bail by the Sessions Court. The copy of said letter
dated 6.3.2011 of Deputy Superintendent, Central Jail, be taken on
record.

Office is
directed to call the papers of Bail Application along with the order
of granting bail to the appellant Jivanji Kalaji Thakor (accused in
Sessions Case No.102 of 1989) and place these Appeals for hearing on
21.3.2011.”

Today,
the papers as well as order as referred above are not received and,
therefore, office is again directed to call for the same and matters
be placed for hearing on 4.4.2011.

FURTHER
ORDER :

After
the above order was passed, today i.e. on 22.3.2011 at 5:00 p.m., the
concerned office bearers has come in my Chamber with the papers of
bail application which shows that the appellant – Jivaji Kalaji
Thakore has been released on bail by the learned Additional Sessions
Judge, City Civil Court, Ahmedabad.

It
is also canvassed by the concerned office bearer that in the Board,
it is mentioned that the papers have been received, but, through,
oversight the same could not be placed and he has admitted his
mistake, but, it is not committed intentionally.

In
view of the above, now, it is not necessary to issue fresh writ.
However, the papers of bail application shall be attached with
Criminal Appeal Nos.539 of 1991 and 600 of 1991.
