JUDGMENT

S. Ravindra Bhat, J.

1. Rule. Ms. Anjana Gosain, learned counsel waives notice of Rule. With consent, the writ petitions were taken up for disposal.

2. In all these petitions, the claim made is identical i.e. for regularisation of the services of the petitioners who have been working as employees for last 3-4 years with the respondent Navyug School which is managed and controlled by the NDMC.

3. Notice had been issued in these proceedings on 18th March, 2005 and by an order services of the petitioners were directed to be continued. The respondents had obtained adjournments from time to time and it was stated during the course of the proceedings that the issue of regularisation was under active consideration of the management of the Nayug School Society.

4. It is not disputed that all the petitioners are Group-D employees working as Peon/Chowkidars or Bal Sahayika respectively. They have been working for 3-4 years.

Ms. Gosain, learned counsel appearing for the management of the respondent No.2 and Mr. Ankur Chhibber, Advocate for Ms. Jyoti Singh, advocate for respondent No.1 submit that by a resolution of the Board of Governors held on 17th November, 2005 and approved on 14th December, 2005, `a decision was taken to regularise the services of various classes of employees, as a one time measure. The relevant part of the said proposal which was accepted and approved and now is part of the policy of regularization of the respondent Navyug School is as follows:

(2) NON TEACHING STAFF:

Keeping in view the various court cases number of available vacant post and reserved points the committee recommended that the points under group ‘D’ and ‘C’ may be clubbed together and these employees who have worked at least for one financial year may be considered for regular appointment against the available posts by examining the work conduct in case of group ‘D’ and conducting a trade test in case group ‘C’ post. The trade test for Group ‘C’ post will be similar to the NDMC post.

6. In view of the above development, learned counsel for the respondent submits that petitioners’ cases would be taken up and duly processed. It is not disputed that the petitioners are eligible and entitled to be considered since they have admittedly worked for more than one financial year.

7. A direction is accordingly issued to the respondent Navyug School Education Society to consider the case of the petitioners and pass suitable order as regards their regularisation in various Group-D posts within a period of four weeks from today. Such orders shall be communicated directly to the petitioners. 8.The writ petitions are allowed in terms of the directions indicated above. No costs.
