as learned Additional Public Prosecutor for the State.
Although, the case has been registered under
Section 376 read with Section 511 of the Indian Penal Code
but submission of learned counsel for the petitioner is that, at
best, a case of Section 354 of the Indian Penal Code is made
out.
Taking into consideration the above stated
submissions as well as this aspect of the matter that the case
has been registered after four days of the alleged occurrence,
let the petitioner be released on bail on furnishing bail bonds
of Rs. 10,000/- (Ten Thousand) with two sureties of the like
amount each to the satisfaction of Chief Judicial Magistrate,
Khagaria in connection with Mansi P.S. Case No. 130 of
2010.
