The
applicant is an accused who was granted bail by order dated 9.8.2010
passed in Criminal Misc. Application No.6240/2010. In the bail order
itself I had recorded the statement of the counsel for the applicant
that applicant is aged about 71 years. This was one of the prime
ground on which I was convinced to grant bail. In this application,
he clarified that applicant is not 71 years old but is aged 41 years.
Necessary correction is therefore, prayed for.
When
the bail order was passed on consideration that applicant is aged 71
years and it is now found that such statement was inaccurate, entire
bail order requires to be recalled and not mere making of correction
as prayed for.
Order
dated 9.8.2010 passed in Criminal Misc. Application No. 6240/2010 is
recalled. Criminal Misc. Application No. 6240/2010 shall be placed
for further hearing.
Criminal
Misc. Application No. 12125/2010 is disposed of accordingly.
