On November 14, 2008, a Coordinate Bench had passed the
following order:
“Present: Mr. H.S. Gill, Senior Advocate with
Mr. Vivek Goyal, Advocate.
Petitioner claims that he is not named in the FIR.
Police, however, sought to involve the petitioner saying that he is
also known as Kinda alias Kanta. Said Kinda alias Kanta is
attributed Kirpan blow on the left leg of the complainant. The
petitioner has further said that one Kulwinder Singh, who is a co-
accused is known as Kinda alias Kanta, is stated to be in
custody.
Notice of motion for 16.1.2009.
In the meanwhile, in the event of arrest of the petitioner,
he shall be released on anticipatory bail to the satisfaction of the
Arresting Officer, subject to the conditions contained in Section
438(2) Cr.P.C. He will join the investigation as and when
required.

Counsel for the State, on instructions from Sub Inspector
Purshotam Lal, has submitted that petitioner has joined the investigation and
in the present case, report under Section 173 Cr.P.C./ challan has been
submitted. Therefore, custodial interrogation of the petitioner is not required.
In view of the statement made by the counsel for the State,
order passed by Coordinate Bench on November 14, 2008 is affirmed.
Petitioner shall be permitted to file regular bail bonds to the satisfaction of
the concerned Court.
With these observations, present petition is disposed off.
