ORDER

1.0. The
applicant by way of this application has prayed for the following
relief :-

?Sa. That the order of
interim directions as prayed for in para 17(1) be granted in the
following terms:

Pending hearing and till
final disposal, the respondents may be restrained from promoting any
other persons-employees to the posts of superintendent
(Administration) in the corporation and from implementing the orders
Anenxure ‘D, E, G,I, 11, 12 and L’ annexed to the petition.

Court [Coram : Anant S. Dave, J.], while admitting the petition has
passed the following order :

advocates appearing for the parties. Rule.

That, no recovery
shall be initiated or effected pursuant to the impugned order. After
pleadings are over, it will be open for the petitioner to move this
Court for appropriate relief.

3.0. Heard. Considering
the facts and circumstances of the case, the implementation of the
orders which are subject matter of this petition will be subject to
the result of this petition. It is made clear that if ultimately the
applicant succeeds, he will get all the retiral benefits which are
subject matter of the petition.

The office is directed
to list the main matter for hearing in July, 2009.

The application stands
disposed of accordingly.
