ORAL ORDER

Mr.

Nanavati, learned advocate for the respondent Doctor and
Insurance Company has submitted that he has received the copy of the
impugned judgment and relevant documents only today and he needs time
to prepare himself for final hearing of the Appeal. The Record &
Proceedings has been received only today and Mr. Shah, learned
advocate for the appellants would like to go through the Record &
Proceedings. Hence, in view of the request made by the parties, S.O.
to 9th April, 2010.

In
the meanwhile, Mr. Shah, learned advocate for the appellants, will,
in furtherance of his suggestion for an overall settlement, make an
offer in writing for full and final settlement and shall give the
offer to Mr. Nanavati, learned advocate for the contesting
respondents. Mr. Nanavati, learned advocate for the contesting
respondents, shall convey the
response of his client to Mr. Shah before the next date of hearing.
If the parties are ready and willing for mediation then both the
parties may jointly inform this Court about the willingness of the
parties to go for mediation even before the next date of hearing. In
that event, appropriate order referring the matter to Mediation
Centre may be passed before the next date of hearing.
