Heard learned counsel for the applicants and the learned A.G.A.
The applicants, through the present application under Section 482 Cr.P.C.
have invoked the inherent jurisdiction of this Court with the prayer that they
should be allowed to furnish fresh bail bonds in the newly added offences
under Section 326 I.P.C. vide Case Crime No. 515/2008, P.S. Fatehganj
(west), District Bareilly, as they have not misused the liberty of bail granted to
them earlier for offences under Sections 323, 506, 326 I.P.C. in the same
crime number.
The prayer of the applicants for the fresh bail bonds can not be accepted.
However, looking to the facts and circumstances of the case and also the fact
that the applicants have not misused their liberty of bail granted to them
earlier, I consider it proper to direct the court below to dispose off the bail
application of the applicants for the aforesaid offences, if possible on the same
day.
With the aforesaid direction, this application is finally disposed off.
