Heard learned counsel for the applicant and learned A.G.A.
appearing for the State.
It is contended by the learned counsel for the applicant that
F.I.R. has been lodged by the orders of the Magistrate in the
application under section 156(3) Cr.P.C. and there is no
recovery of any incriminating article from the possession of
the applicant. Complainant himself has given statement to
the Investigating Officer that the fact administering the
poison has been introduced on the advice of the counsel.
Learned A.G.A. contended that there is allegation against
the applicant and co-accused that they were administering
the poison and committing the murder of the deceased.
F.I.R. was lodged after much delay. Applicant has no
criminal history and he is in jail since 30.5.2010.
Considering the facts and circumstances of the case and
submissions made by the learned counsel for the applicant
and without expressing any opinion on the merits of the
case, the applicant is entitled to be released on bail.
Let the applicant Bantole involved in Case Crime No. 126
of 2010, under Sections 394, 328, 302 IPC Police Station
Indargarh District Kannauj be released on bail on his
furnishing a personal bond with two sureties each in the like
amount to the satisfaction of the court concerned.
