Heard learned counsel for the applicant and the learned A.G.A. and perused
the record.
It is contended by learned counsel for the applicant that applicant is not
named in the FIR, in the alleged incident, the kidnapped boy Yash has been
recovered from the possession of Vishnu, the name of the applicant has been
disclosed by co-accused Hublal, at the most it can be said that the applicant
was also involved in hatching conspiracy, no active role has been assigned to
the applicant, there is no allegation with regard to the ransom etc., the
transaction of ransom has not taken place. The case of the applicant is
distinguishable with the case of the other co-accused. He is having no
criminal antecedent. He is in jail since 8.1.2010.
In view of the facts and circumstances of the case and submissions made by
the learned counsel for the applicant and without expressing any opinion on
the merits of the case the applicant is entitled to be released on bail.
Let the applicant Bantu involved in case crime no. 1092 of 2009, under
section 364-A I.P.C. , P.S. New Agra, District Agra be released on bail on
his furnishing a personal bond and two heavy sureties each in the like amount
to the satisfaction of the Court concerned with the conditions.
• That the applicant shall not tamper with the evidence.
• That he shall report to the court of C.J.M. concerned in the first week
of each month to show his good conduct and behaviour till conclusion
of the trial.
In case of default of any of the above mentioned conditions, the bail granted
to the applicant shall be deemed cancelled and he shall be taken into custody
forthwith.
