learned Senior Advocate Mr.B.B.Naik with learned Advocate Mr.Vimal
M.Patel for the petitioner.

Learned
Senior Advocate for the petitioner moves draft amendment. The same
is allowed.

2. Learned
Senior Advocate for the petitioner invited attention of the Court to
‘Japti Notice’, a copy of which is produced at page No.158 and
the order passed by the Gujarat State Cooperative Tribunal in
application seeking condonation of delay dated 04.11.2010, a copy of
which is produced at page No.132. Learned Senior Advocate for the
petitioner also invited attention of the Court to the order passed by
the Hon’ble Tribunal in similar application on 22.10.2010.

2.1 Learned
Senior Advocate for the petitioner submitted that there was no reason
for the Hon’ble Tribunal to take pass contradictory orders in similar
matters. Learned Senior Advocate for the petitioner also asserted
that in the second application seeking condonation of delay in filing
appeal before the Hon’ble Tribunal, except time gap of four months,
there was hardly any difference of facts.

3. NOTICE
returnable on 13.12.2010.

Ad
interim relief in terms of para-15-C-(i) & (ii), on
condition that the petitioner shall file an undertaking to this Court
to the effect that he will not transfer, either ownership or the
possession, in any manner whatsoever.

Undertaking
to be filed on or before 29.11.2010.
