The Court : This is an application for appointment of a valuer to

assess the value of some of the contents of the bank locker.

It will be open to the propounder to obtain the valuation from a

government registered jewellery valuer. For the purpose of assessing the

value of the articles, the propounder and the valuer will have access to the

bank locker being locker no.367 at the Patipukur Branch, Bank of Baroda.

The Manager of such branch should facilitate the inspection of the articles

by the valuer in the presence of an officer of the bank. It is made clear

that the articles will not be removed from the bank without express order

of Court or until the probate is granted.

Upon the valuation being made, the propounder will be entitled

to carry out necessary amendments in the affidavit of assets filed along

with the application for grant of probate. It is recorded that the

propounder has submitted that the propounder is the only son of the

alleged testatrix and that the other intestate heirs of the alleged testatrix

would have been the sister of the propounder and their father, who have

consented to the grant.

G.A.No.1460 of 2011 is allowed as above without any order as

to costs.

Urgent certified photocopies of this order, if applied for, be

given to the parties subject to compliance with all requisite formalities.
