ORAL
ORDER

(Per
: HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)

In
the present case, as we find that no prejudicial order or judgment is
under challenge, learned counsel for the appellant after some
argument sought permission to withdraw this appeal to enable the
appellant to move before learned Single Judge for grant of interim
relief. We allow the appellant to do so, but it is left to learned
Single Judge to decide the question of grant of interim relief. The
appeal is dismissed as withdrawn.
