ORDER
Heard
learned advocate for the applicant and learned APP Mr.Mengde for
respondent State.
2. Rule.
Mr.Mengde, learned APP waives service of rule on behalf of the
respondent State.
3. The
applicant has been arrested on 6.9.2008 in connection with the
offence being CR No.III-5056 of 2008 for the offences punishable
under Sections 66B, 65AE, 116(2)B and 81 of the Bombay Prohibition
Act.
3. Taking
into consideration the gravity of the offence and the applicant being
a lady, this application deserves to be allowed and accordingly it is
allowed. The applicant is ordered to be released on bail on her
executing a personal bond in sum of Rs.5,000/- (Rupees Five thousand
only) with a surety of like amount before the lower Court, on the
following conditions that she shall,
(a) not
take undue advantage of her liberty or misuse her liberty;
(b) not
to act in a manner injurious to the interest of the prosecution;
(c) maintain
law and order;
(d) mark
his presence before the concerned police station on every 1st
day of the month between 9.00 a.m. and 2.00 p.m.
(e) not
leave the State of Gujarat without the prior permission of this
Court/Sessions Judge concerned;
(f) furnish
the address of her residence to the I.O. and also to the Court at
the time of execution of the bond and shall not change the residence
without prior permission of this Court;
(g) surrender
his passport, if any, to the lower Court within a week.
7. If
breach of any of the above condition is committed, the learned
Sessions Judge concerned will be free to issue warrant or take
appropriate action in the matter.
8. Bail
before the lower Court having jurisdiction to try the case.
9. Rule
is made absolute. Direct service is permitted.
