ORAL ORDER

Leave
to amend the prayer clause (c) and the word ‘opponent’s advocate’ be
deleted.

Heard
Mr. M. B. Gandhi, learned advocate appearing for the petitioner and
Mr. Mehul Sharad Shah, learned advocate appearing for the
respondent.

Having
gone through the averments made in the application as well as the
documents produced by the respondent before the Executing Court, the
Court directs the petitioner to deposit a sum of Rs.3250/- before
the Executing Court which would make sufficient compliance of the
order passed by this Court on 03.08.2009 and on that condition, the
warrant issued by the Executing Court shall not be executed against
the applicant.

It
is expected that in future, the directions issued by this Court in
the pending Revision Application shall be complied with. It is also
made clear that as per the order passed by the Trial Court, the rent
includes taxes and the amount so deposited by the applicant would
cover the payment of entire rent + taxes upto 31.07.2010.

With
this direction, this Civil Application is accordingly disposed of.
