Heard learned counsel for the petitioner and learned A.P.P. for the
Prosecution.

Petitioner has been made accused for the offence under Sections 366A
and 494 of the Indian Penal Code, in connection with Ramgarh P.S. Case no.304
of 2010, corresponding to G.R. No. 3552 of 2010.

The FIR was lodged by the mother of the victim stating that her minor
daughter was kidnapped by the petitioner. Subsequently, the victim was recovered
and her statement was recorded under Section 164 Cr.P.C. in which she has
supported the prosecution case that she was kidnapped by the petitioner, her
signature was taken on a paper on which something was written on which there
was also a photograph of the petitioner and the victim. She has also stated that
she does not want to live with the petitioner nor she wants to marry him.

Learned counsel for the petitioner submitted that the petitioner has actually
married the girl and the marriage certificate has been brought on record.

In the facts and circumstances of the case, particularly in view of the
statement made by the victim under Section 164 Cr.P.C., I am not inclined to
release the petitioner on bail. Accordingly, prayer for bail stands rejected.
