By
order dated 20th July 2011 passed in Special Civil
Application No.8071 of 2011, that matter was ordered to be heard
along with this matter. However, taking into consideration the facts
of the case, this matter is heard separately.
2. Heard
learned advocate Mr.Munshaw for the petitioner. The petitioner is
before this Court being aggrieved by order dated 15th
January 2011 passed by the Appellate Authority under the Payment of
Gratuity Act, 1972 rejecting Appeal No.45 of 2010 on the ground of
delay. Learned advocate Mr.Munshaw invited attention of the Court
to the application filed for condonation of delay along with appeal
filed before the Appellate Authority under the Payment of Gratuity
Act. Learned advocate Mr.Munshaw invited attention of the Court to
para 2 of said application dated 17th September 2010.
3. The
matter requires consideration. RULE returnable on 12th
September 2011. Direct service is permitted.
