ORDER

1. The
matter is being adjourned from time to time. Lastly, the appeal was
listed on 30.08.2010 when, at the request of Mr.Shah, learned
advocate for the appellant, it was adjourned to 1st
September, 2010. On 1st September, 2010, the appeal had to
be adjourned to 6th September, 2010. In view of the
request made by Mr. Shah, learned advocate that in all probability,
he is likely to retire from the proceedings as advocate for the
appellant.

3. Today,
Mr. Shah has informed that he has been instructed, by his client to
retire from the proceedings as appellant’s advocate and that
therefore, he has handed over the papers of the appeal to his client
i.e. the appellant.

4. The
appellant Mr.Bhawanisinh Dadbha Vala is present in the Court. He has
confirmed that he has asked advocate Mr. Shah to retire from the
proceedings.

5. Mr.

Vala, the appellant, who is present in the Court, has, on one hand,
requested for early hearing of the appeal and when the Court
suggested to schedule the hearing of the appeal tomorrow i.e.
07.09.2010 he requested for more time to instruct his advocate, who
is now to be engaged in place of Mr. Shah. He has requested for at
least two to three days’ time. Since there will be holidays on 10th,
11th and 12th and since this Court has also
the roster of writ petitions arising from the Civil Courts’ orders,
which are being taken up for hearing on Thursdays and Fridays. S.O.
to 13th September,
2010.(particularly
the appellant, in person, has asked for more time and not agreed for
hearing on 7th
September, 2010).
