The
present application is for condonation of delay of 31 days in
preferring appeal against the judgment and award dated 05.10.2010
passed by the learned 6th Additional Senior Civil Judge,
Surat in Land Reference Case No. 86 of 1996.

The
respondent is served but none appears.

Considering
the facts and circumstances, in view of the grounds stated in the
application for condonation of delay, sufficient cause is made out.
Hence the delay caused in filing the First Appeal is condoned.

This
application is allowed accordingly. Rule made absolute accordingly.
No order as to costs.
