ORDER
The present
application has been filed by the Applicant accused under Section
439 of Criminal Procedure Code for grant of regular bail as a
successive bail application.
The Applicant had
earlier filed Criminal Misc. Application No. 4024 of 2009 which was
withdrawn as per the order dated 18.6.2009.
The Applicant
accused is charged with having committed offence under Sections 302,
34, 201, 120B, 364, 506(2) and 114 of the Indian Penal Code, for
which complaint has been lodged being I-CR No.169 of 2008 with
Karjan Police Station.
As there are no change
in the circumstances and the Court was not inclined, learned
advocate Mr. P.P.Majmudar for the applicant accused seeks permission
to withdraw the present application. Permission is granted. The
present application stands disposed of as withdrawn. Rule
discharged.
