ORAL ORDER

I
have perused the note of the Registry dated 11.05.2010, based upon
communication dated 07.05.2010 of Mr.B.S.Patel, learned counsel,
addressed to the Registrar General, High Court of Gujarat.

Today,
when the matter is taken up, Mr.Chirag B. Patel, learned advocate for
Mr.B.S.Patel, learned counsel for the petitioner submits that Civil
Application No.3804/2009 has been wrongly mentioned and in fact, it
should be Civil Application No.3804/2007. On perusal of the note of
the Registry, this position is not coming on the record as the said
note refers to the application as Civil Application No.3804/2009. The
note of the learned advocate dated 07.05.2010 reveals that there is
an interpolation where the number of Civil Application No.3804/2009
is mentioned.

There
appears to be some confusion regarding the correct number of the said
Civil Application, therefore, no orders can be passed on the note put
up by the Registry, at this stage. The learned counsel for the
petitioner may put up a fresh note indicating the correct position
before the Registry, and the Registry may verify the same.
