Heard learned counsel for the petitioners and perused the averments made
in the writ petition and also the First Information Report.

By means of present writ petition, the petitioner sought relief for quashing
of the FIR dated 6.4.2009 registered as case crime no. 228 of 2009 under
Section 364 IPC, P.S. Dataganj, District- Budaun.

We have perused the averments made in the writ petition and also the FIR
and we are of the considered opinion that prima-facie cognizable offence has
been made out. We are not inclined to quash the FIR.

It is accordingly dismissed.
