                                           JUDGMENT

1. The petitioner is present in person as the lawyers are

observing strike.

2. The petitioner has approached this Court against his

transfer from Government Secondary School, Kumhar Pada, Jaisalmer

to Government Secondary School, Delasar. He has filed a

representation (Annex.3) dtd.3.9.2010 to the Dy. Director (Secondary

Education), Jodhpur.

3. Considering the submissions made at the bar and in

view of the fact that the petitioner has already represented to the

competent authority, but the same has not been decided by the

reasoned and speaking order, it is considered expedient to dispose of

this writ petition by directing the respondents to decide the same by

speaking order dealing with the relevant facts and circumstances of

the case within a period of 3 weeks from today. It is only after such

speaking order is passed and the same is adverse to the petitioner that

the petitioner is free to avail his legal remedy.

4. Till such representation is decided by the competent

authority, the operation of the impugned order dtd.30.8.2010

(Annex.2) qua the petitioner shall remain stayed.

5. With these observations, the present writ petition is

disposed of. No order as to costs. A copy of this order be sent to the

opposite party.

6. A copy of this order be supplied to the petitioner free of

cost.
