The petitioners are accused in the case registered for the offence under
sections 8(A), 25, 27, and 27(A) of the Narcotic Drugs Psychotropic Substance
Act.
Learned counsel for the petitioners submitted that the petitioners have
been falsely implicated in the case; they are local villagers; they have no
concern with the cultivation of posta plant; the lands described in the F.I.R. do
not belong to the petitioners; petitioners have got no criminal antecedents;
petitioners are in custody since April,2010; petitioners are local permanent
residents; there is no chance of their absconding.
Learned APP opposed the prayer for bail of the petitioners, but has not
disputed the contention made by the learned counsel for the petitioners.
Regard being had to the facts and circumstances of the case, the above
named petitioners are directed to be released on bail on furnishing bail bond of
Rs.10,000/-(ten thousand)each with two sureties of the like amount each to the
satisfaction of learned Sessions Judge-cum-Special Judge, Hazaribagh in
connection with Barkagaon P.S. case no.33 of 2008, corresponding to G.R.
no.745 of 2008.
