5 29-8-2011 Heard learned counsel appearing on behalf of the
appellant and learned counsel appearing for respondent
no.1/plaintiff on I.A.No.2161 of 2011 for stay of further
proceeding of Execution Case No. 01 of 2011 pending
before Additional Munsif II, Chapra.
The learned counsel appearing on behalf of
respondent no.1 has stated that the next date in the
Execution Case is 15th September, 2011 C.P.C. and he has
prayed that the appeal itself be heard for admission under
Order 41 Rule 11 C.P.C. The learned counsel appearing on
behalf of the appellant has also agreed to this proposal.
As such, let this Interlocutory application be
heard along with S.A.No.603 of 2010, which shall be placed
for hearing under Order 41 Rule 11 C.P.C. on 13th
September, 2011.
