04. 24.09.2010 The appellant, Bijay Rajwanshi @ Ramdhani

Rajwanshi is alleged to have assaulted the deceased

with Lathi behind the right ear. This fact has

consistently been stated before the Court by P.Ws. 3,

5 and 10 and also corroborated by the evidence of

P.W. 11, Dr. Rajkishore Prasad, who conducted the

post-mortem report. The injury inflicted by the

appellant is the cause of death of the deceased.

Considering this fact, prayer for bail on behalf

of the appellant is rejected.
