03/- 21/11/2011 Heard learned counsel for the petitioner and learned

Additional Public Prosecutor for the State, who is armed with carbon

/xerox copy of the case diary up to paragraph – 24 dated 17/07/2010.

The petitioner apprehending his arrest, in connection with

Fulwaria P.S. Case No. 135 of 2008 for the offence punishable under

Sections 407, 420, 120(A)/34 of the Indian Penal Code, pending in the

court of Chief Judicial Magistrate, Begusarai.

After some arguments, learned counsel for the petitioner

seeks permission to withdraw this application with a liberty to

surrender before the court below within a fortnight for a prayer of

regular bail, where the submission as regard to denial of ownership of

the truck involved in spite of petitioner being owner of different trucks

shall be considered on its own merit, without being prejudiced of

instant withdrawal.

Permission is granted.

Accordingly, this application stands disposed of as

withdrawn.
