2. 18.10.2011 The petitioners have come to this Court for a
direction to permit them to appear in the interview on the
post of Pharmacist which is to commence from 24.10.2011.
They claim age relaxation in view of the fact that as per the
earlier order of this Court dated 21.7.1999 passed in
C.W.J.C.No.4302 of 1998 it appears that appointment on
the post of Pharmacist had not been made for a long period
of time and stop-gap arrangements on ad-hoc basis were
being continued and it is mentioned that advertisements
were issued in the year 1992 in some of the surgencies;
accordingly this Court directed the question of relaxation of
age to be considered and the same was found mentioned in
the advertisement dated 25.1.2000 published by the
Directorate of Health Services, but yet no such decision
regarding age relaxation has been given.
Learned counsel for the petitioners relies upon two
decisions of this Court in the case of Bishun Dutta Jha &

Ors vs. B.P.S.C. & Ors. : 1999(2) PLJR 215 and
Dr.Rabindra Kumar Singh & Ors. vs. State of Bihar & Ors.
: 2000(3) PLJR 231 in which in similar circumstances
direction for relaxation of age has been given.
Learned counsel for the Bihar Staff Selection
Commission, however, points out that the interview will
continue till 8.12.2011 which gives sufficient time for the
purpose of decision being taken by the State Government in
the matter with respect to all the candidates and not merely
the petitioners before this Court.
It is, accordingly, directed that the State Government
shall take a decision in the matter of age relaxation in terms
of the directions of this Court by order dated 21.7.1999
within a period of two weeks from today and convey the
same to the Bihar Staff Selection Commission so that
further interview letters may be issued by the Commission
in terms of the decision of the State Government.
