This application has been filed on behalf of

Appellant no. 1 Bipin Yadav for grant of bail, which

was earlier rejected considering the fact that he has

fired on the deceased.

Considering the evidence of eye witnesses

PWs 3 and 7 as well as post-mortem report and medical

evidence of PW 10, we find that the appellant cannot

be allowed bail for the present as he has remained in

custody only for four and half years.

Prayer for bail is rejected at this stage.
