This is an application under Section 482

of the Code of Criminal Procedure seeking

quashing of order dated 19.03.2009 passed in

ABP No. 8224/2008 by Sessions Judge, Patna,

refusing to modify the earlier order dated

16.12.2008 passed in ABP No. 8224 of 2008.

After some arguments, learned counsel

for the petitioner seeks permission to withdraw

this application. Permission is granted.

Accordingly, this application stands

dismissed as withdrawn.
