03. 20.07.2011 Heard learned counsel for the petitioner and
respondent no.3.
Petitioner seeks a direction upon the respondents to
grant him the benefit of the Assured Career Progression (ACP)
Scheme on completion of 12 years and 24 years of services.
According to him, he completed 12 years of service on 9.8.1999
and 24 years of service on 01.05.2008.
Both parties have taken a very fair stand before this
Court.
Learned counsel for the petitioner submits that
petitioner would be raising the aforesaid grievance(s) before
respondent no.3 by filing a detailed representation which may be
directed to be considered and disposed of within stipulated
period.
Mr. Verma appearing on behalf of Patna Municipal
Corporation, submits that if any such representation is filed, the
said respondent shall consider and dispose of the same in
accordance with law by a reasoned order.
Having heard both parties, this Court disposes of the
present application by the following order:

“Let the petitioner file a detailed
representation supported by all documents in his
possession together with a copy of the present order
within four weeks before respondent no.3 (Municipal
Commissioner, Patna Municipal Corporation, Patna). If
any such representation is filed in the manner aforesaid,
respondent no.3 shall consider and dispose of the same
in accordance with law within six weeks of its filing.
If the order disposing of the application admits the
claim of the petitioner, then the authority shall ensure
that the said benefit(s) are made available to the
petitioner as quickly as possible.”
