6. 16.12.2010 It has been submitted that the vehicle which met with

an accident resulting in the death of the son of the respondent

Nos. 1 and 2 was being used as a commercial vehicle even

though it had been insured as a private vehicle.

Issue notice to the respondents No. 1, 2 and 3 to

show cause as to why this application be not allowed/disposed

of at the stage of admission itself. Notices would go under

ordinary process for which Talbana etc. must be filed within

three weeks failing which the memo of Appeal shall stand

rejected without further reference to the Bench.
