The prayer in the writ petition is to direct the first respondent to issue necessary orders on the clarification sought for by the second respondent on the appointment of the applicant on compassionate grounds as stated by second respondent in his letter No.60964/N.A.2/93 dated 14.6.97 within a period of three months.
2.The O.A. has been filed in the year 1998 by one C.Natarajan aged about 39 years, son of late K.Chidambaram who died of harness as a Road Inspector in the Highways and Rural Works in division Trichy. Since the claim for compassionate appointment was not considered, the present O.A. has been filed.
3.The petitioner has made several representations for considering his claim for compassionate appointment. The petitioner made a representation for redressal of his grievance to the Chief Minister’s Special Cell. The Special Officer of the Chief Minister Relief Cell sent a reply dated 14.06.1997 and stated that this matter is under active consideration by the competent authority.
4.The learned counsel for the petitioner states that the issue has not been considered so far and the matter is still pending before the competent authority. The Government Advocate is not able to state as to the present status of the petitioner’s claim.
5.In view of the above, if the claim of the petitioner for compassionate appointment has not been considered on merits so far, the first respondent Secretary to Government of Tamil Nadu, Highways Department, and the second respondent the Chief Engineer, Highways and Rural Works Department are directed to consider the representation of the petitioner for compassionate appointment on merits.
6.In any event, the petitioner is entitled to make further representation in this regard and the same shall also be considered on merits and the petition shall be disposed off within a reasonable period of time preferably within a period of three months from the date of such representation. The petition stands disposed off with the above direction. No costs.
