The Applicant filed an RTI application dt.7.9.09 with the PIO, North Western Railway HQ seeking the following information: i) Whether the sheet prepared and got vetted in connection with payment of arrear of 6 th CPC to the applicant is correct in all respect. ii) The reasons of showing zero amount against Jan.2006 and less payment drawn/due in Feb.2006 iii) Whether the basic pay drawn for the month June to Oct.2006 is correct. If yes, how iv) If not, what should be the correct amount. v) The details of correct arrear due separately 40% and 60% with break up of contribution towards PF, Income tax and net arrears. Shri Rajeev Singh, PIO replied on 7.10.09 enclosing the point wise information dt.6.10.09 furnished by the concerned nodal officer. Not satisfied with the reply, the Applicant filed an appeal dt.13.10.09 with the Appellate Authority. Shri Ambarish Kumar Gupta, Appellate Authority replied on 28.10.09 informing the Applicant that points 3 and 4 fall outside the ambit of RTI Act as they are seeking opinions of the PIO and with regard to points 1,2 and 6 he enclosed the vetted statement of arrears. Being aggrieved with the reply, the Applicant filed a second appeal dt.20.11.09 before CIC requesting the Commission to provide information against points 1 to 4 while pleading for the missing part of the information against item no.5. 2.
