On behalf of the Respondent, Shri Jyothirlingam was present. 2. In this case, the Appellant had, in his application dated 6 July 2009, requested the CPIO for the marks awarded to the officers in the written test held on 16 December 2007 and the interview and PAR by the DPC held in April 2009. In his reply dated 24 July 2009, the CPIO declined the information by citing the provisions of Section 8(1) (d) of the Right to Information (RTI) Act. Not satisfied with this reply, the Appellant preferred an appeal on 3 August 2009. The Appellate Authority rejected the appeal in his order dated 10 August 2009. Consequently, the Appellant has come before the CIC in second appeal. 3. We heard this case through videoconferencing. The Appellant was not CIC/SM/A/2009/001517 present in spite of notice. The Respondents were present in the Jaipur studio of the NIC. We heard their submissions. Very strangely, it was argued that the Appellant was not a citizen of India since he happened to be the secretary of a staff union. If the information had been denied on this ground, we can say that this was most unfortunate. A citizen does not cease to be one merely because he holds a position in any society or association or organisation. Therefore, no information can be denied only on this ground. 4.
