Central Information Commission Mr.B D Tupta vs Ministry Of Railways on 22 July, 2010 Central Information Commission CIC/AD/A/2010/000838 Dated July 22, 2010 Name of the Applicant : Shri  B.D. Gupta Name of the Public Authority : Northern Railway, New Delhi Background 1. The RTI application was filed by the Applicant on 28.7.09 with the PIO, Northern Railway, New Delhi  seeking any rule which clarifies whether  a member of running staff residing in Running Room at his  own H. Q station  is  entitled to get HRA of Rs.2000/­pm  or not.  The APO, DRM Office, NR replied  on 10.12.09 enclosing therewith a photocopy of printed serial no. 6979 giving the required rules.  Not  satisfied with this reply the Applicant filed his first appeal on 15.9.09 seeking information once again.  The AA replied on 12.10.09 once again provided the relevant rule.  Still not satisfied, the Appellant  then filed his second appeal on 12.4.10 before the Commission stating that information provided is  incorrect.  2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing for July 22,  2010.   3. Shri Mohar Singh, PIO, and Shri S.P. Mahi, AA represented the Public Authority.  4. The Applicant was present during the hearing. Decision 5. The Commission on perusal of the submissions on record holds that relevant information has been  provided in response to the question in the RTI application.   The Appellant stated that the rules  provided to him are applicable for those in the officer’s category and not below.   The Respondent,  however, refuted this contention and informed the Commission that another reply had been sent to by  DPO on 6th  July, 2010 to the Appellant   informing him that   no HRA would be admissible in such  cases where Railway premises are used by the employees as residence.  It was evident that no HRA  would be given irrespective of category of employee or whether the  Rly premises are a running room  or a rest House.  […]
