Counsel for the respondent prays for passing over this case today on the
ground that his file has been misplaced. Counsel for the appellant submits that
no counter affidavit has been filed till date.

In the facts and circumstances, it is directed that counter affidavit may be filed
within one month. In the meantime, counsel for respondent may reconstruct
his file. It is made clear that no further time shall be granted for filing counter
affidavit.
