03 14.09.2011 Heard learned counsel for the petitioner as well as

learned Additional Public Prosecutor for the State.

Petitioner is in jail custody since 23.02.2011 in a case

initially, registered under Sections 414 of the Indian Penal Code, 25

(1-b)a, 26 and 35 of the Arms Act and subsequently, Section 26(ii) of

the Arms Act was also added.

Allegedly, petitioner was caught red handed with loaded

pistol containing seven live cartridges and one country made katta was

recovered from the room in which the raid was conducted.

The Superintendent of Police, Purnea has reported that

petitioner does not have any criminal antecedent and as per

submission of learned counsel for the petitioner, the petitioner has

been implicated in this case at the behest of his enemies.

Considering the aforesaid facts and circumstances as

well as submissions of the parties, let the petitioner be released on bail

on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two

sureties of the like amount each to the satisfaction of Chief Judicial

Magistrate, Purnea in connection with K. Nagar P.S. Case No. 54 of

2011.
