02/ 1st August 2011 This Letters Patent Appeal has been
preferred against the judgment and order dated
24.8.2010 passed in CWJC No. 485 of 2010
dismissing the writ on the ground that the High Court
is not an executive court.
Since the appellant’s caste has already
been declared by Civil Courts, therefore, it is binding
on the all the Government and its authority and it has
to be given due effect and benefit arising thereof out of
the decree.
With the aforesaid observation, the appeal
is disposed of.
