2 28.6.2011 This is an application for restoration

of Cr.Misc.No. 41685 of 2009 which stood

dismissed on 3.5.2011 for non-prosecution on

behalf of petitioner. However, it is submitted

that the counsel for the petitioner could not

mark the case in daily cause list and as such no

body could appear before the Court to press the

case and accordingly the case was dismissed for

default.

In view of submissions, the restoration

application is allowed and Cr.Misc.No. 41685 of

2009 is restored to its original file.
