02. 25.03.2011 Learned counsel for the petitioners seeks permission to

withdraw the application of petitioner no.3 Chumman Singh.

Permission is accorded.

Accordingly, this application of petitioner no.3 is

dismissed as withdrawn.

Heard learned counsel for the rest petitioners and the

state.

Petitioners are alleged to come informant’s door abuse

her (informant) in name of her (informant’s) caste ‘Dhobi’,

assaulted her (informant) and others and shot firing to create terror is

denied on the ground that informant’s son dashed one Sahil, who

was taken to hospital. Villagers decided to incur the cost by family

members of the informant, to deny the same, this false case is

lodged with no specification as who among petitioners really abused

the informant in name of her caste.

Having regard to the facts and circumstances of the case,

in the event of arrest or surrender within a period of one month from

the date of receipt/production of a copy of this order, the above

named petitioner nos. 1,2, 4, 5 and 6 shall be released on bail on

furnishing bail bond of Rs.10,000/- (ten thousand) each with two

sureties of the like amount each to the satisfaction of the Sub-

divisional Judicial Magistrate, Sikrahana at Motihari, East

Champaran in connection with Patahi P.S. Case No.43 of 2010,

subject to the conditions as laid down under section 438(2) of the

Cr. P.C.
