Rule.
Mr. R.C. Kodekar, learned APP waives service of Rule on behalf of the
opponent State.
This
is an application for temporary bail on the ground of sickness of
mother of the accused in connection with the offence registered with
Udhna police station, Surat vide CR No. I 306 of 2008.
It
is submitted that the mother of the accused aged about 85 years is
suffering from certain ailments and she has been advised to be
admitted in hospital for treatment. The accused is hailing from very
poor strata of society and needs to arrange for funds to get his
mother treated.
Papers
as regards ailment of the mother are on record. It also appears that
earlier, accused was enlarged on temporary bail on two occasions on
the ground of his mother’s ailment and has surrendered in time.
Having
regard to the facts and circumstances of the case, the accused is
ordered to be released on temporary bail for a period of two weeks
from the date of his release on his executing a bond of Rs.15,000/-
[Rupees Fifteen Thousand only] before the jail authority. The
applicant was not living where his mother is residing and therefore,
he shall mark his presence at Patan Town Police Station on every
alternate day. He shall not leave the city of Patan during the period
of his temporary bail and shall surrender before the jail authority
in time on expiry of period of temporary bail.
The
application is partly allowed. Rule is made absolute to the aforesaid
extent.
