The present writ petition has been preferred for issuance of a
direction to the Director, Welfare Department, Government of
Jharkhand, Ranchi, respondent No.3, for issuing letter of appointment to
the petitioners against sanctioned and vacant post of Class-IV as junior
to the petitioners whose names were recommended in the district panel
after the petitioners were already issued letter of appointment in their
favour.
2. The main contention raised by the petitioners are that their
legitimate claim has been ignored. The second contention raised by the
petitioners is that the names recommended from the district panel were
junior to the petitioners. The entire claim and the prayer is based on
annexure 8 which is letter No.1472, which does not include the
petitioners.
3. I have considered the arguments and the pleadings including the
order passed by this Court and it will be evident that those who were
appointed were from the district panel prepared pursuant to order
passed by this Court and the petitioners were not included in the district
panel. There is no legal, accrued or vested right in favour of the
petitioners to claim appointment as a matter of right. Even otherwise the
appointment sought to be challenged were made by annexure 8 in
compliance to the order passed by this High Court dated 14.6.2002 in
Writ Petition (S) No.4936 of 2001
4. Considering the aforesaid facts and circumstances of the case, I
find no merit in this writ petition and the same is accordingly dismissed.
