Having
heard the counsel for the petitioner and being satisfied with the
ground, we condone the delay and recall the order dated 24.9.2009
passed in Letters Patent Appeal (Stamp) No.1566 of 2009, subject to
condition that the petitioner will remove the defect within 15 days,
failing which the appeal will not be registered and this order will
stand recalled.

The
Misc. Civil Application stands disposed of with the aforesaid
observations.
