The
applicant has taken out this application for seeking recalling of the
order dated 25/11/2009 passed by this Court in Special Civil
Application No. 10633 of 2009, as the same was dismissed for default
for want of appearance on behalf of the petitioner’s advocate. When
this application is called out Shri Bhushan Oza is present for the
applicant. After hearing Shri Oza, this Court is of the view that the
application deserves to be allowed and accordingly it is allowed. The
order dated 25/11/2009 passed in Special Civil Application No. 10633
of 2009 is hereby recalled. The matter, i.s. Special Civil
Application No. 10633 of 2009 is restored to file and to come up for
hearing in due course before the appropriate Court.
